Terms of Service

These terms cover the MakeTheBoard website at maketheboard.com and the MakeTheBoard apps for iOS and Android. Section 10 adds terms that apply specifically to the app downloaded from the Apple App Store.
1. Acceptance of terms
By accessing or using MakeTheBoard, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.
2. Description of service
MakeTheBoard is a platform for creating and managing leaderboards, scoreboards, and goal trackers, available on the web and as apps for iOS and Android. We offer free and paid subscription plans with varying features.
3. Accounts
- You must provide accurate information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 13 years old to use the service.
4. Acceptable use
You agree not to:
- Use the service for any unlawful purpose
- Upload offensive, harmful, or misleading content
- Attempt to access other users' accounts or data
- Interfere with the operation of the service
- Scrape or bulk-download data from the platform
5. Subscriptions and billing
Paid plans are offered on monthly and yearly terms. How you are billed, and how you cancel, depends on where you bought the subscription.
5.1 Purchases made on our website
Website purchases are billed through Stripe and renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period, and you keep access until then. Refunds are handled on a case-by-case basis.
5.2 Purchases made in our mobile apps
Subscriptions bought inside the iOS or Android app are sold and billed by Apple or Google, not by us. Payment is charged to your App Store or Google Play account at confirmation of purchase.
These subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the price shown at the time of purchase.
You must manage and cancel these subscriptions in your App Store or Google Play account settings. We cannot cancel them for you, and we cannot issue refunds for them. Refunds for store purchases are granted at the sole discretion of Apple or Google under their own policies. Deleting your MakeTheBoard account does not cancel a store subscription.
6. Content ownership
You retain ownership of all content you create on MakeTheBoard (boards, scores, participant data). We do not claim any intellectual property rights over your content. You grant us only the permission needed to host, store, and display that content in order to operate the service for you.
7. Service availability
We strive to keep MakeTheBoard available 24/7 but do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect availability.
8. Limitation of liability
MakeTheBoard is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service.
9. Termination
We may suspend or terminate accounts that violate these terms. You may delete your account at any time from your account settings, in the app or on the website. If you have a subscription bought through a store, cancel it separately as described in section 5.2.
10. Additional terms for the Apple App Store
The following applies if you obtained the MakeTheBoard app from the Apple App Store. In this section, "Application" means the MakeTheBoard iOS app.
- Acknowledgement. These terms are between you and MakeTheBoard only, and not with Apple. MakeTheBoard, not Apple, is solely responsible for the Application and its content.
- Scope of licence. We grant you a non-transferable licence to use the Application on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Maintenance and support. MakeTheBoard is solely responsible for providing maintenance and support for the Application. Apple has no obligation to furnish any maintenance or support.
- Warranty. MakeTheBoard is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Application to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Application.
- Product claims. MakeTheBoard, not Apple, is responsible for addressing any claims relating to the Application, including product liability claims, any claim that the Application fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- Intellectual property claims. MakeTheBoard, not Apple, is responsible for the investigation, defence, settlement, and discharge of any third-party claim that the Application infringes that third party's intellectual property rights.
- Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must comply with any applicable third-party terms of agreement when using the Application.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms, and upon your acceptance Apple will have the right to enforce them against you as a third-party beneficiary.
- Contact. Questions, complaints, or claims about the Application should be directed to contact@maketheboard.com.
11. Changes to terms
We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the updated terms.
